Terms and Conditions

These terms and conditions apply to all orders submitted to Wasabi HQ online store on wasabihq.pl (referred to as “the store”), covering all purchase agreements that a consumer enters into online with Wasabi HQ and its owner PMC Marcin Chmiel, (referred to as “us” or “Wasabi HQ”). We encourage our buyers (referred to as “you” or “the customer”) to read these terms and conditions in their entirety before using the store or submitting an order. These terms and conditions may be updated and vary from time to time. Please check them prior to every order you place in the store.

2. THE CONCLUSION OF CONTRACT

The presentation of the products does not constitute a binding contract offer. To place an order, you must follow the online shopping process of adding the desired goods to your virtual shopping cart and following the shopping process on the checkout page. You have the chance to review your order and then confirm it by paying with chosen payment method.
By completing this step, the customer submits a legally binding offer of contract with regard to the goods contained in the shopping cart.
When your offer to buy from us is received, you get an automatic acknowledgement of receipt (“order confirmation email”) to the email address you submitted. Please note that this does not mean that your order has been accepted, it merely documents that your order has been received.
A binding purchase agreement is entered into as soon as your order has been accepted by Wasabi HQ and a shipping confirmation email has been sent to the email address you submitted.
The order can only be submitted if the customer has accepted these terms and conditions by ticking the box "I AGREE TO THE TERMS AND REFUND POLICY."
Contract languages is English.
An order is possible for registered customers as well as for guest customers.

3. PRICES & INVENTORY

Occasionally there may be information in the Store that contains errors or inaccuracies, relating to product descriptions, pricing, promotions, offers, and availability. We reserve the right to correct any errors or inaccuracies, to update information or cancel orders if any information in the Store is inaccurate at any time without prior notice (including after you have submitted your order).
If an item happens to run out of stock before the status has been correctly updated on the Store, Wasabi HQ will notify the customer via email. We may then suggest an alternative item, or cancel the order in question and fully refund your purchase. If incorrect price information has been shown in the Store you will be given the opportunity to either purchase the item at the correct price, or cancel the order. Wasabi HQ reserves the right to cancel a purchase agreement if fraud is suspected.
The prices in our Store constitute the total price (including sales tax for transactions within the EU), but do not include delivery costs. Those will be indicated separately during the checkout process. In the case of deliveries to countries outside the European Union, additional costs may apply, such as payment fees and customs fees. Those costs will have to be paid by the customer.

4. DISCOUNTS & GIFT CARDS

We reserve the right to change prices and discount items from time to time without prior notice. Gift Card codes or discount codes are only valid once per person (unless otherwise stated) and only within the stated period of time. They may not be combined or transferred to another purchase. Gift Cards cannot be bought with discount codes.

5. PAYMENT

Payment is currently only possible in the currency set out in the Store, which is Euro (€). Payment can be carried out by credit or debit cards. Available payment methods vary depending on your location and shipping destination.
Payment is due immediately after conclusion of the contract, unless the parties have arranged a later date. If payment is pending, Wasabi HQ reserves the right to halt the shipment until full amount has been received. A purchase may be declined if payment did not go through or fraud is detected.

6. CONTRACTUAL OBJECT

The nature of the ordered goods results from the product descriptions in the online shop. Images on the website may reflect the products inaccurately; especially for technical reasons Images are for illustrative purposes only and may differ from the product. Descriptions of specifications, weight, measures and performance are as precise as possible, but may have the usual deviations.

7. SHIPPING PRICES & TIMES

Wasabi HQ accepts and processes purchases in the same order in which they are submitted to the Store. The delivery of goods is subject to availability. The processing time is between 1-5 working days. Shipping is processed via Poczta Polska S.A. or FexEx sp. z o. o.. All shipping costs will be specified during the checkout process, so that the cost is clearly visible to you prior to completing the order.

8. DELIVERY

If a purchase sent to you is returned as undeliverable, we reserve the right to charge you a fee covering the cost of the shipping.
Should your order be delayed you will receive a notification via email. You may cancel the order and get a full refund if you do not accept the new suggested time of delivery. If the order has already been dispatched you will have to return the ordered items in order to receive repayment.
All items dispatched via FedEx sp. z o. o. are insured by Wasabi HQ up to a certain amount. Should you discover any damage to the package prior to opening it, please take a photo and report this to our customer support: hello@wasabihq.com as soon as possible. Items that are damaged during transportation need to be sent back and are replaced by Wasabi HQ free of charge.
If you have already opened the package when you notice the damage, please read section "10. DAMAGED PRODUCTS"

9. RETURNS & EXCHANGES

You are always entitled to return or exchange your items within 14 days from the time of delivery. To return an item, please follow the instructions provided on our Shipping & Returns page.
The costs for the return of the order is covered by Wasabi HQ.
Make sure the items you want to return are unused, unwashed and placed in their original packaging including all tags for a full refund. Feel free to re-use our packaging to ship your return package.
Please note that the responsibility for the return is yours until it reaches us, so we recommend that the return shipment is insured and traceable. Wasabi HQ will repay the price of the item as soon as possible, however at the latest within 30 days from the date the item was returned and received by us. The funds will be returned to your original method of payment.
For hygiene reasons, swimwear and underwear are non-returnable and non-exchangeable.
If you wish to exchange your order for a different item, color or style, please feel free to just place a new order in our online shop. You may also reach out to our customer service team if you need help!

10. DAMAGED PRODUCTS

Wasabi HQ ensures that all products go through several quality control procedures before being dispatched to our customers. We work hard to avoid damages or defects in our products. Should you receive a faulty item, please send us an email including a photo of the defect within 14 days from the time of delivery.
If you would like to exchange your item for a new one, we will replace your item with a new sample of the item in question, if a new one is available. If a new item is not available, you will be refunded with the original cost of the item and the return cost.
We will refund you as soon as possible, however at the latest within 30 days from the date the item was returned and received by us and we have established that the item is damaged or otherwise defective. The funds will be returned to your original method of payment.

11. RIGHT OF WITHDRAWAL

You have the right to withdraw from this contract within 14 days without giving any reason. The cancellation period is 14 from the day on which you took possession of the goods.
In order to exercise your right of withdrawal, you must inform us via email: hello@wasabihq.com by means of a clear statement of your decision to withdraw from this contract.

12. COLORS

While we do our best to accurately represent the items in the pictures, we cannot guarantee that the colors shown in the store reflect the items’ colors in reality. The colors can be shown in different ways depending on your computer or phone screen and settings.

13. OWNERSHIP

Until full payment, the delivered goods remain the property of the seller.

14. FINAL PROVISIONS

Should any provision of these Terms and Conditions be ineffective, this shall not affect the remaining provisions. In place of the invalid provision, the relevant statutory provisions apply.
Polish law applies.
The place of fulfillment and jurisdiction is, as far as legally permissible, for deliveries and payments as well as all disputes arising between the parties, Poland. For end-consumers, the place of performance and jurisdiction is the buyer's place of business.
